Cheiz Terms of Service

Article 1 (Purpose)

The purpose of these Terms is to set out the rights, obligations and responsibilities of the Service and its users in relation to the use of internet-related services (the "Service") provided by Cheiz, which is owned and operated by LIFESHOT.Inc (the "Company").

Article 2 (Definitions)

  1. "Cheiz" means the virtual place of business established by the Company using computers and other information and communications equipment so that users may post and view content and transact paid services; it is also used to mean the business operator running the cyber mall.
  2. "User" means a member or non-member who accesses Cheiz and receives the services provided by Cheiz under these Terms.
  3. "Member" means a person who has registered with Cheiz and may continuously use the services provided by Cheiz. Members of Cheiz are divided into photographer members and general members. ① A photographer member is an individual or corporation who, having been granted authority through consultation with the Company, joins the Service and may upload photographs taken, confirm orders and provide product services. ② A general member is a person who may freely register for the Service, purchase photographs taken on a Cheiz photo tour, manage them in an album, and leave reviews of products. General members may pay for the paid services provided by Cheiz and receive the corresponding benefits.
  4. "Nickname" means the letters, numbers or a combination thereof selected by a member and approved by the Company for identification of the member and the member's use of the Service.
  5. "Content" means all content within the Cheiz service, including the Cheiz notices provided by Cheiz to "members" through the Service and the posts and comments uploaded by "members" to the Service.
  6. "Paid Services" means the various original photo albums, photo retouching and related services provided by the Company for a fee to general members who have paid for paid services.

Article 3 (Specification, Explanation and Amendment of the Terms)

  1. Cheiz shall post on the front page of the Cheiz website, so that users may easily know them, the content of these Terms, the trade name and the name of the representative, the address of the place of business (including the address of the place where consumer complaints may be handled), the telephone number, the e-mail address, the business registration number, the mail-order business report number, and the personal information manager. However, the content of the Terms may be made available for users to view through a linked screen.
  2. Before a user agrees to the Terms, Cheiz shall provide a separate linked screen or pop-up screen so that the user may understand important matters set out in the Terms, such as withdrawal of subscription and refund conditions, and shall obtain the user's confirmation.
  3. Cheiz may amend these Terms to the extent that they do not violate relevant laws, including the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, and the Framework Act on Consumers.
  4. Where Cheiz amends the Terms, it shall specify the effective date and the reason for amendment and give notice on the initial screen, together with the current Terms, from seven days before the effective date until the day before the effective date. However, where the Terms are changed to the disadvantage of users, notice shall be given with a prior grace period of at least 30 days. In such case, Cheiz shall clearly compare the content before and after amendment and display it so that users may easily understand it.
  5. Where Cheiz amends the Terms, the amended Terms shall apply only to contracts concluded on or after the effective date, and the provisions of the Terms prior to amendment shall continue to apply to contracts already concluded before that date. However, where a user who has already concluded a contract sends to Cheiz, within the notice period for the amended Terms under Paragraph 3, an indication of intent to be governed by the amended provisions and obtains Cheiz's consent, the amended provisions shall apply.
  6. Matters not provided for in these Terms and the interpretation of these Terms shall be governed by the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce determined by the Fair Trade Commission, and relevant laws or commercial practice.

Article 4 (Provision and Change of Services)

  1. Cheiz performs the following business: ① Providing information on goods or services and concluding purchase contracts ② Assisting the smooth conclusion of subscription contracts between photographer members and general members ③ Other business determined by the Company
  2. Where paid services are discontinued or benefits are changed, Cheiz may change the content of paid services by contracts to be concluded in the future. In such case, Cheiz shall immediately give notice of the changed content of the paid services and the date of provision at the place where the current content of the paid services is posted.
  3. Where the content of a paid service that Cheiz has contracted with a user to provide is changed due to discontinuation of sale or change of benefits, Cheiz shall immediately notify the user of the reason at an e-mail address at which the user can be notified.
  4. In the case of the preceding paragraph, Cheiz shall compensate for the damage suffered by the user as a result. However, this shall not apply where Cheiz proves that there was no intent or negligence on its part.

Article 5 (Suspension of Services)

  1. Cheiz may temporarily suspend the provision of the Service where there is maintenance, inspection, replacement or breakdown of computers or other information and communications equipment, or interruption of communications.
  2. Cheiz shall compensate for damage suffered by users or third parties due to the temporary suspension of the Service for the reasons in Paragraph 1. However, this shall not apply where Cheiz proves that there was no intent or negligence on its part.
  3. Where the Service can no longer be provided due to conversion of the line of business, abandonment of business, merger between companies or similar reasons, Cheiz shall notify users by the method set out in Article 8 and compensate consumers in accordance with the conditions originally presented by Cheiz. However, where Cheiz has not given notice of compensation standards, it shall pay users in kind or in cash commensurate with the degree of damage suffered by users.

Article 6 (Membership Registration)

  1. A general member applies for membership registration by entering member information in accordance with the registration form determined by Cheiz and then indicating an intent to agree to these Terms.
  2. A photographer member applies for membership registration through the following procedure: ① Consulting with the Company regarding Cheiz photographer membership and agreeing to proceed with registration ② Providing member information in accordance with the registration form determined by Cheiz to the Cheiz administrator ③ The administrator creating an account for each photographer and notifying the photographer that registration has been completed
  3. Cheiz shall register as members those users who have applied for membership under Paragraph 1, unless they fall under any of the following: ① Where the registered content contains falsehoods, omissions or errors ② Where registering the applicant as a member is otherwise judged to cause significant technical difficulty to Cheiz
  4. Where there is any change to the matters registered at the time of membership registration, every member shall notify Cheiz of such change within a reasonable period by means such as amending the member information.

Article 7 (Withdrawal, Loss of Qualification and Content Deletion Measures)

  1. A member may request withdrawal from Cheiz at any time, and Cheiz shall process the withdrawal immediately.
  2. Where a member falls under any of the following, Cheiz may restrict or suspend the member's qualification: ① Where false information was registered at the time of application ② Where the member fails to pay by the due date the price of paid services purchased using Cheiz or other obligations borne by the member in relation to the use of Cheiz ③ Where the member threatens the order of electronic commerce, such as by obstructing another person's use of Cheiz or misappropriating their information ④ Where the member uses Cheiz to engage in acts prohibited by law or these Terms or contrary to public order and good morals
  3. Where a member's "content" falls under any of the following, Cheiz may temporarily delete such "content": ① Content that violates the Cheiz terms of service or the law ② Content that has been reported three or more times by other members
  4. After Cheiz temporarily deletes content, the member who uploaded that content may, within 30 days, demonstrate that it does not fall under the grounds for violation and have the measure lifted.

Article 8 (Notice to Members)

  1. Where Cheiz gives notice to a member, it may do so to the e-mail address designated by prior agreement between the member and Cheiz.
  2. In the case of notice to an unspecified number of members, Cheiz may substitute individual notice by posting on a screen accessible to all members within the app for at least one week. However, individual notice shall be given for matters that have a material effect on the member's own transactions.

Article 9 (Purchase Application and Consent to Provision of Personal Information)

  1. Users of Cheiz apply for purchase on Cheiz by the following or similar methods, and Cheiz shall provide each of the following in an easily understandable manner when the user makes a purchase application: ① Selection of the paid service product ② Confirmation of the content of the Terms and of services for which the right of withdrawal is restricted ③ An indication confirming or refusing these Terms and the matters in the preceding subparagraph ④ Application to purchase the paid service and confirmation thereof, or consent to Cheiz's confirmation ⑤ Selection of the payment method
  2. Where Cheiz needs to provide a purchaser's personal information to a third party, it shall inform the purchaser of and obtain consent to: 1) the recipient of the personal information, 2) the recipient's purpose of using the personal information, 3) the items of personal information provided, and 4) the period for which the recipient will retain and use the personal information. (The same applies where the matters consented to are changed.)
  3. Where Cheiz entrusts a third party with the handling of a purchaser's personal information, it shall inform the purchaser of and obtain consent to: 1) the entrustee of the personal information handling, and 2) the content of the entrusted work. (The same applies where the matters consented to are changed.) However, where this is necessary for the performance of a contract concerning the provision of services and relates to the enhancement of the purchaser's convenience, the notification and consent procedures may be omitted by giving notice through the personal information handling policy in the manner prescribed by the Act on Promotion of Information and Communications Network Utilization and Information Protection.

Article 10 (Formation of Contract)

  1. Cheiz may decline a purchase application under Article 9 in any of the following cases: ① Where the application contains falsehoods, omissions or errors ② Where accepting the purchase application is otherwise judged to cause significant technical difficulty to Cheiz ③ Where the purchaser is confirmed to be under 14 years of age
  2. The contract shall be deemed formed at the time Cheiz's acceptance reaches the user in the form of the receipt confirmation notice under Article 12, Paragraph 1.
  3. Cheiz's indication of acceptance shall include confirmation of the user's application, whether the service can be provided, and information regarding correction and cancellation.

Article 11 (Payment Methods)

The method of paying for paid services purchased on Cheiz may be any available method among the following. However, Cheiz may not additionally collect any fee under any name on the price of paid services in relation to the user's payment method. ① Prepaid card ② Debit card ③ Credit card ④ Other card payments of various kinds

Article 12 (Receipt Confirmation Notice; Change and Cancellation of Purchase Application)

  1. Where there is a purchase application from a user, Cheiz shall give the user a receipt confirmation notice.
  2. A user who has received a receipt confirmation notice may, where there is a discrepancy in the indication of intent, request a change or cancellation of the purchase application immediately after receiving the notice, and where there is such a request from the user before delivery, Cheiz shall process it without delay in accordance with the request. However, where payment has already been made, the provisions on withdrawal of subscription in Article 15 shall apply.

Article 13 (Provision of Paid Services)

  1. Types of paid services ① Original photographs taken on a photo tour may be purchased. ② Photo retouching may be requested from a photographer for a fee.
  2. Benefits of paid services ① The right to download original photographs is provided. ② Overall colour correction of original photographs and detail retouching of subjects may be requested from a professional photographer. ③ An in-app album in which purchased photographs may be stored is provided.
  3. Revenue and settlement of paid services ① A certain portion of the revenue from paid services is settled to photographers in order to support their creative activities. ② The ratio, cycle and standards of revenue settlement shall follow the individual contract and policy between the photographer and Cheiz.
  4. Rules for use of paid services ① Where a purchaser of paid services violates the service operation terms, use of the Service may be suspended or restricted without prior notice, even during the membership period. ② Benefits related to paid services are provided only to the person concerned and may not be transferred or sold to others. ③ Where transfer or sale is discovered, membership may be revoked without prior notice and use of the Service may be restricted. ④ Where content downloaded under the benefits of paid services provided by Cheiz is reproduced and distributed to third parties, leaked, or used commercially, legal liability such as a civil claim for damages may arise.
  5. Restrictions on use and restriction for those under 14 years of age ① Cheiz does not provide the Service to children under 14 years of age. ② If a child under 14 years of age has made a payment, their legal representative may request cancellation of the payment through the customer centre.
  6. Service supply procedure and confirmation method ① The time of provision of a paid service varies according to the nature of each service and is specified to the customer on the product detail page or in the guidance text. ② Where a service is provided immediately upon purchase, the customer may check the status of use on the "Purchase History" page within the Service. ③ Where a problem arises in the provision of the Service, Cheiz will inform the customer by e-mail.
  7. Service period and compensation for damage

Cheiz shall specify the period of use of paid services on the product detail page and, where it fails to comply, shall compensate the customer for damage. However, Cheiz may be relieved of liability where it proves that there was no intent or negligence on its part.

Article 14 (Refund)

Where the services applied for by a user cannot be delivered or provided due to discontinuation of sale or similar reasons, Cheiz shall notify the user of the reason without delay and, where it has received payment for the paid service in advance, shall refund the payment or take the measures necessary for a refund within seven business days from the date of receipt of the payment.

Article 15 (Withdrawal of Subscription)

  1. A user who has concluded a contract with Cheiz for the purchase of paid services may withdraw the subscription within seven days from the date of receipt of the written document concerning the content of the contract under Article 13, Paragraph 2 of the Act on Consumer Protection in Electronic Commerce (or, where the supply of the goods or services took place later than receipt of that document, from the date on which the goods or services were supplied or the supply began). However, where the Act on Consumer Protection in Electronic Commerce provides otherwise regarding withdrawal of subscription, the provisions of that Act shall apply.
  2. After completing payment for a paid service, a user may not return or exchange it in any of the following cases: ① Where the user has withdrawn their Cheiz membership ② Where the purchased photograph has been downloaded ③ Where a photographer has accepted a retouching request for a product with a retouching option selected ④ Where seven days have passed since payment
  3. A user may obtain a refund if none of the matters in Article 15, Paragraph 2 above applies. Refunds are available at [My Page – Settings – Payment History].
  4. Where Cheiz has not taken measures such as clearly stating, in a place where consumers can easily become aware of it, the fact that withdrawal of subscription is restricted, the user's withdrawal of subscription shall not be restricted.
  5. Notwithstanding Paragraphs 1 and 2, where the content of the Service differs from the content displayed or advertised, or is performed differently from the content of the contract, a user may withdraw the subscription within three months from the date of supply of the goods concerned, or within 30 days from the date on which the user became aware or could have become aware of that fact.

Article 16 (Effects of Withdrawal of Subscription)

  1. Where Cheiz receives a request for withdrawal of subscription for a paid service from a user who does not fall under Article 15, Paragraph 2, it shall refund the price of the goods or services already received within three business days. In such case, where Cheiz delays the refund of the price of the goods or services to the user, it shall pay delay interest calculated by multiplying the delay period by the delay interest rate prescribed in Article 21-2 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce.
  2. In refunding the above price, where the user paid for the goods or services by means of payment such as a credit card or electronic money, Cheiz shall without delay request the business operator that provided such means of payment to suspend or cancel the claim for the price of the goods or services.
  3. In the case of withdrawal of subscription, the user shall bear the costs necessary for the return of the services supplied. Cheiz shall not claim a penalty or damages from the user on the ground of withdrawal of subscription. However, where the withdrawal is made because the content of the goods or services differs from that displayed or advertised or is performed differently from the content of the contract, Cheiz shall bear the costs necessary for the return of the services.

Article 17 (Protection of Personal Information)

  1. When collecting personal information from users, Cheiz collects the minimum personal information necessary for the provision of the Service.
  2. Cheiz does not collect in advance, at the time of membership registration, information necessary for the performance of a purchase contract. However, this shall not apply where identity verification is required before a purchase contract in order to perform obligations under relevant laws and a minimum of specific personal information is collected.
  3. When collecting and using a user's personal information, Cheiz notifies that user of the purpose and obtains consent.
  4. Cheiz may not use collected personal information for purposes other than the stated purpose and, where a new purpose of use arises or the information is provided to a third party, notifies the user of the purpose at the stage of use or provision and obtains consent. However, exceptions apply where relevant laws provide otherwise.
  5. Where Cheiz must obtain a user's consent under Paragraphs 2 and 3, it shall specify or notify in advance the matters prescribed in Article 22, Paragraph 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, including the identity of the personal information manager (affiliation, name, telephone number and other contact details), the purposes of collection and use of the information, and matters relating to the provision of information to third parties (the recipient, the purpose of provision and the content of the information to be provided); and the user may withdraw such consent at any time.
  6. A user may at any time request access to and correction of errors in their own personal information held by Cheiz, and Cheiz bears an obligation to take the necessary measures without delay. Where a user requests correction of an error, Cheiz shall not use the personal information concerned until the error has been corrected.
  7. For the protection of personal information, Cheiz shall limit to a minimum the persons who handle users' personal information, and bears full responsibility for damage to users caused by loss, theft, leakage, provision to third parties without consent, or alteration of users' personal information, including credit card numbers.
  8. Cheiz, or a third party that has received personal information from it, shall destroy the personal information without delay once the purpose of collection or the purpose for which it was provided has been achieved.
  9. Cheiz does not pre-select the consent boxes relating to the collection, use and provision of personal information. Cheiz also specifies concretely which services are restricted if a user refuses consent to the collection, use and provision of personal information, and does not restrict or refuse the provision of services such as membership registration on the ground that a user refuses consent to the collection, use or provision of personal information that is not a mandatory collection item.

Article 18 (Obligations of Cheiz)

  1. Cheiz shall not engage in acts prohibited by law or these Terms or contrary to public order and good morals, and shall do its utmost to provide goods and services continuously and stably in accordance with these Terms.
  2. Cheiz shall have in place a security system to protect users' personal information (including credit information) so that users may use internet services safely.
  3. Where a user suffers damage because Cheiz engages in unfair labelling or advertising in respect of goods or services as prescribed in Article 3 of the Act on Fair Labelling and Advertising, Cheiz shall be liable to compensate for such damage.
  4. Cheiz shall not send commercial advertising e-mail that users do not wish to receive.

Article 19 (Obligations Regarding Member ID and Password)

  1. Except in the case of Article 17, responsibility for the management of the ID and password rests with the member.
  2. A member shall not allow a third party to use their ID or password.
  3. Where a member becomes aware that their ID or password has been stolen or is being used by a third party, the member shall immediately notify Cheiz and, where Cheiz provides guidance, shall follow it.

Article 20 (Obligations of Users) Users shall not engage in the following acts.

  1. Registering false information when applying or making changes
  2. Misappropriating another person's information
  3. Altering information posted on Cheiz
  4. Transmitting or posting information other than that determined by Cheiz (such as computer programs)
  5. Acts infringing the copyright or other intellectual property rights of third parties, as follows: ① Producing "content" as separate image or video files at will ② Using or processing the original "content" to generate separate revenue ③ Posting "content" on the internet at will ④ Providing "content" to third parties at will ⑤ Any other act infringing copyright in "content"
  6. Any other act that damages the reputation of, or obstructs the business of, a third party
  7. Disclosing or posting on Cheiz obscene or violent messages, images, audio, or other information contrary to public order and good morals
  8. Repeatedly posting identical or similar content so as to interfere with the normal operation of the Service
  9. Making payment by misappropriating another person's payment account
  10. Conducting advertising, promotional or commercial activities within the Service without the permission of Cheiz

Article 21 (Relationship between Linking Cheiz and Linked Cheiz)

  1. Where an upper-level Cheiz and a lower-level Cheiz are connected by hyperlink (the object of a hyperlink may include text, images and moving images), the former is called the linking Cheiz (website) and the latter the linked Cheiz (website).
  2. Where the linking Cheiz states on its initial screen, or on a pop-up screen at the time of connection, that it does not bear warranty liability for transactions conducted with users through goods or services independently provided by the linked Cheiz, the linking Cheiz shall not bear warranty liability for such transactions.

Article 22 (Attribution of Copyright and Restrictions on Use)

  1. Copyright and other intellectual property rights in works photographed and produced by Cheiz belong to Cheiz.
  2. A user shall not use, for commercial purposes, information obtained through the use of Cheiz in which intellectual property rights belong to Cheiz, by reproduction, transmission, publication, distribution, broadcasting or other methods without the prior consent of Cheiz, nor allow a third party to do so.
  3. A member may upload to the Service content that does not violate copyright law, and the intellectual property rights in such content belong to the member as the producer of the work.
  4. By uploading content to the Service, a member grants Cheiz a worldwide licence to use that content by means of use, storage, reproduction, modification, public transmission, display and distribution.
  5. Cheiz shall not use a member's content for purposes not provided for in Paragraph 4 and, where such use is unavoidable, shall obtain separate consent from the user who posted the work before use.
  6. A member has the right to request deletion of, or refusal of use of, postings they have uploaded.

Article 23 (Dispute Resolution)

  1. Cheiz shall establish and operate a damage compensation handling body in order to reflect legitimate opinions or complaints raised by users and to compensate for their damage.
  2. Cheiz shall give priority to handling complaints and opinions submitted by users. However, where prompt handling is difficult, Cheiz shall immediately notify the user of the reason and the handling schedule.
  3. Where a user applies for damage relief in connection with an electronic commerce dispute arising between Cheiz and the user, the dispute may be subject to mediation by a dispute mediation body entrusted by the Fair Trade Commission or a Mayor/Do Governor.

Article 24 (Jurisdiction and Governing Law)

Litigation concerning electronic commerce disputes arising between Cheiz and a user shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the user's address at the time of filing or, where there is no address, over the user's place of residence. However, where the user's address or place of residence is unclear at the time of filing, or in the case of a foreign resident, the action shall be brought before the competent court under the Civil Procedure Act. Effective date: These Terms apply from 23 March 2025.
